The petitioner seeks bail in Maner P.S. Case No. 329 of 2014, registered for the offences punishable under Sections 376 and 34 of the Indian Penal Code.
The victim made specific allegation that the petitioner committed rape with her and also took photographs. Again on 18.08.2014, the petitioner committed rape with her. Learned counsel for the petitioner submits that the victim is a lady of easy virtue. The victim is mother of two children. During the course of investigation no independent witness has supported the prosecution case.
Considering the allegation made against the petitioner, I am not inclined to enlarge the petitioner above named on bail.
Patna High Court Cr.Misc. No.5376 of 2015 (3) dt.29-04-2015 2/2 Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same preferably within one year from the date of receipt/production of a copy of this order.
