JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Bisfi P.S. Case No. 227 of 2015 for the offences instituted under Sections 341, 323, 354 and 302/34 of the Indian Penal Code.

As per prosecution case that all the accused persons reached at the door of the informant and began to abusing by coaccused Lal Bahadur Mandal in the meantime, informant fled away from the place of occurrence but his father not succeed to fled away because he was handicapped and said co-accused Lal Bahadur brutally assaulted by his leg on abdomen of his father and

Patna High Court Cr.Misc. No.1810 of 2016 (4) dt.18-03-2016 on hulla villagers came and save his father thereafter took his father at his house in the next morning suddenly his father serious pain and thereafter he died.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Specific allegation is against Lal Bahadur Mandal. No specific injury has been attributed nor any specific overt-act has been alleged against the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Bisfi P.S. Case No. 227 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Benipatti, Madhubani, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
