JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 9.10.2014 in a case registered for the offences punishable under Sections 326,307,427 and 120B/34 of the Indian Penal Code and sections 3 of Explosive Substances Act.

The prosecution case is that the informant went to Civil Court, Chapra for deposing as a witness then explosives were thrown by co accused Mahesh Rai and Dhiraj Singh. The FIR was lodged against 11 accused persons. Petitioner was not named in the FIR but his complicity surfaced during investigation. It is submitted by the learned counsel for the petitioner that the FIR named accused Baleshwar Singh, Mdhu Kumari and Khushboo Kumari have been granted bail vide Cr. Misc. No.

Patna High Court Cr.Misc. No.22826 of 2015 (2) dt.13-07-2015 2/2 49990 of 2014.

Considering the specific accusation of throwing explosives by co accused Mahesh Rai and Dhiraj Singh, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Chapra Town P.S. Case No. 277 of 2014. Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case defaults without any reasonable cause on three consecutive occasions.
