JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners along with several other co-accused are named in the first information report with allegation that petitioners as well as other co-accused mercilessly assaulted the deceased, as a result of which deceased died in course of his treatment.
At the very outset, learned counsel for the petitioners points out that co-accused Ganesh Mahto and ten others have already been granted privilege of anticipatory bail by different Benches of this Court and, similarly, one co-accused Anandi Mahto, having more or less similar allegation, has already been
Patna High Court Cr.Misc. No.14227 of 2016 (2) dt.07-04-2016 2/2 granted privilege of regular bail by a co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties and, particularly, taking note of this fact that the case of these petitioners stands on similar footing to that of co-accused, who are enjoying the privilege of bail, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S.Case No. 217 of 2015.
