The petitioner seeks bail in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is the husband and he is innocent. The informant is not an eye witness of the occurrence. It appears that the petitioner is alleged to have shot his wife dead because she was protesting the ill behaviour of the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Rosera P.S. Case No. 117 of 2014 pending in the court of the learned Additional Chief Judicial Magistrate, Rosera district Samastipur.

Patna High Court Cr.Misc. No.21007 of 2015 (3) dt.03-09-2015 The prayer for bail of the petitioner is, accordingly, rejected. However, the learned trial court is directed to expedite the trial of the petitioner and conclude the same within one year from the date of receipt/production of a copy of this order.
