This Letters Patent Appeal has been preferred against the judgment and order dated 07.11.2017 passed in C.W.J.C. No. 12769 of 2016 (Badri Sao Vs. The State of Bihar & Ors) by a learned Single Judge whereby the learned Single Judge has been pleased to dispose of the writ application observing therein that in view of the nature of order this Court intends to pass, this Court is
Patna High Court L.P.A No.1695 of 2017(5) dt.12-12-2019 2/2 not inclined to adjourn the matter for filing of the counter affidavit or for issuance of notice to private respondent nos. 6 to 10 namely Kajari Devi, Sunil Singh, Gorelal Singh, Yogendra Singh and Awadhesh Singh.
After the matter was heard for some time, learned counsel seeks permission to withdraw the present petition reserving liberty to first approach the respondents by way of a representation, which the appellant intends to make within a period of four months.
Learned A.G. states that without prejudice to the respective rights and contentions of the parties, such representation, if so made, shall be considered and decided in accordance with law within a period of three months from the date of receipt thereof.
Liberty is reserved to the appellant to approach the Court, if the need so arises.
The appeal stands disposed of as withdrawn with the liberty aforesaid.
