JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-12-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Since the physical court proceeding is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within three weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. Learned counsel for the petitioner seeks permission to withdraw this application because the petitioner has been granted bail by the learned court below.

Permission is granted.

Call for a report from the learned District and Sessions Judge, Patna in what circumstance, the court below has granted bail to the petitioner when the regular bail application of the petitioner is pending before the Hon'ble Court. If the petitioner has suppressed this fact that regular bail petition is pending before the Hon'ble Court, the court below has directed to take legal action against the petitioner according to law.
