The petitioner is in custody since 12.1.2015 in a case registered under Sections 304B and 328/34 of the Indian Penal Code.

The prosecution case, in brief, is that the informant Sadanana Mandal gave a written application to the S.H.O., Kursakanta P.S. stating therein that on 11.1.2015 at 5 A.M. he received a call that her daughter, namely, Munni Devi has been murdered, upon which the informant came to Sasural of his daughter at Vilage-Maratipur. He saw the dead boy of his daughter lying on the verandah and husband of the daughter fled away. Some villagers told the informant that occurrence was ensued due to theft of some ornament. Accused persons, namely, Pramod Mandal, the petitioner, Rekha Devi, Sivanand Mandal and Tara Devi had assaulted the daughter of informant by giving poison, due to which she died. The occurrence has always taken place for dowry. Further, he alleged that the

Patna High Court Cr.Misc. No.21273 of 2015 (2) dt.13-07-2015 2/2 accused persons demanded a motorcycle and a buffalo and Rs.75,000/- as dowry. On non-fulfilment of dowry demand, they tortured and assaulted and they theft ornament of his daughter and killed her.

It is submitted on behalf of the petitioner that the charge sheet has been submitted in the case. Further, it is submitted that the petitioner is the mother-in-law of the deceased. It is further submitted that the petitioner has got no concern with the husband of the deceased.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Kursakanta P.S. Case No.8/2005.
