Petitioner seeks bail in a case registered under section 370 of the Indian Penal Code as well as section 16 of the Bonded Labour System Abolition Act.

Petitioner was caught by the informant and other police officials while he was carrying two children aged about 15 and 16 years respectively and the informant claims that the aforesaid children were being carried by the petitioner for getting employed them as bonded labours.

The contention on behalf of the petitioner is that both the aforesaid children are co-villager of the petitioner and, as a matter of fact, the aforesaid children were going along with the petitioner with permission of their respective parents.

Considering the aforesaid facts and circumstances as well as

No.14651 of 2016 (2) dt.12-04-2016 submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 22.1.2016, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Ist Class, Samastipur in Darbhanga (Rail) Sitamadhi P.S. Case no. 07/2016.
