The petitioner is languishing in custody since 22.09.2014 in a case registered for the offences punishable under section 392 of the Indian Penal Code.
It is alleged that Rs.50,000/-, Rs.34,000/- and two mobiles of the informant were robed by three motorcycle born miscreants out of which Kaushal Yadav and Dilip Yadav. The FIR was registered against unknown. The name of the petitioner sprang up during investigation. Statement has been made in paragraph 9 of the petition that the petitioner has not been put on TIP. Moreover, the investigation has already concluded. Considering the above-mentioned facts, let the

No.24209 of 2015 (2) dt.14-07-2015 2/2 above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Bakhtiyarpur P.S. Case No.308 of 2009..
Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
