JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.12.2015 in a case registered for the offences punishable under sections 20/22 of N.D.P.S. Act.

From the house of the petitioner one kg. Ganja was recovered.

It is submitted by learned counsel for the petitioner that recovery is from joint family house. Moreover, the quantity has been assessed on speculation and even assuming the accusation, the recovered quantity is small one. Though, the petitioner is accused in four other cases but none of the cases are registered under the NDPS Act and in those cases the petitioner is on bail. The investigation has already been concluded. Considering the quantity of recovered contraband

Patna High Court Cr.Misc. No.14862 of 2016 (2) dt.06-04-2016 2/2 coupled with the fact that the investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Patna in connection with Special case No. 38 of 2015, Digha P.S. Case No. 338 of 2015. The learned court below shall positively cancel the bail bonds of the petitioner in case the petitioner gets involved in similar offence or defaults without any reasonable cause on three consecutive occasions.
