JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This is an application for grant of anticipatory bail in connection with Gandhi Maidan P. S. Case No. 122 of 2019, disclosing offences under Sections 406, 420, 465, 466, 467, 468, 469, 471, 472, 474, 120B of IPC.
It appears that a sting operation was conducted and the same was displayed on the News 18 showing that petitioner, who is Member of the Selection Committee of Bihar Cricket Association has selected a player on accepting huge amount and thereafter, the present case has been lodged against him. Submission of the learned counsel for the petitioner is that the informant happens to be the Secretary of one CAB, Muzaffarpur, who is not authorized association whereas the petitioner is the Member of the Selection Committee of Bihar
Patna High Court CR. MISC. No.32588 of 2019(5) dt.27-09-2019 2/2 Cricket Association recognized by Cricket Control Board and there is provision of Ombudsman also and matter is under enquiry before him, as such, on the basis of the news report, the petitioner cannot be made responsible for any offence. He is ready to co-operate in the trial, as well as in enquiry. Heard learned A.P.P. also.
Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub- Judge-XVII-cum-Additional Chief Judicial Magistrate, Patna, in connection with Gandhi Maidan P. S. Case No. 122 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate the I.O. as well as the Ombudsman.
