JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-05-2023 The present petition has been filed for modifying the order dated 29.04.2023, passed in Cr. Misc. No.73187 of 2022 to the effect that the designated court, as mentioned in the said order dated 29.04.2023 as the learned Court of Sessions Judge, Araria at Forbesganj be replaced and the same be mentioned as the learned Court of Chief Judicial Magistrate, Araria at Forbesganj.
The learned counsel for the petitioner has submitted that on account of inadvertence, the designated Court has been wrongly mentioned in the original petition itself, hence the aforesaid error has crept in the said order dated 29.04.2023, hence the same be corrected.
Having regard to the facts and circumstances of the
Patna High Court CR. MISC. No.35443 of 2023(2) dt.25-05-2023 2/2 case, I deem it appropriate to direct that the name of the designated Court, as mentioned in the aforesaid order dated 29.04.2023 be deleted and the same be read as the learned Court of Chief Judicial Magistrate, Araria at Forbesganj. Accordingly, the time granted to the petitioner to surrender before the learned trial court and avail the privilege of bail is extended by a further period of four weeks from today. The petition stands disposed off with the aforesaid modifications in the order dated 29.04.2023, passed in Cr. Misc. No.73187 of 2022.
