JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-06-2016 Learned counsel for the petitioner seeks permission to make correction in prayer portion in view of the changed circumstances. Permission is granted to the learned counsel for the petitioner to make correction during course of the day. The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 20.02.2015 passed in Criminal Misc. No. 48284 of 2014, on the ground that the petitioner is in custody since 26.03.2014, up till now charges have not been framed and in near future trial is not likely to be concluded though there was direction to conclude the trial at the earliest. The petitioner is not named in the F.I.R., and considering his period of abscondance his prayer for bail was earlier rejected and now by remaining in custody he has been sufficiently

Patna High Court Cr.Misc. No.18169 of 2016 (3) dt.28-06-2016 2/2 penalized to which the learned A.P.P, submits that this is the case of year 1999.

In the facts and circumstances stated above, considering that in near future trial is not likely to be concluded and as such considering the period of detention of the petitioner now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Suresh Prasad Mishra, Additional Sessions Judge IX, Gaya, in G.R. No. 87 of 1999/ Trial No. 732 of 2007 arising out of Paraiya P.S. Case No. 04 of 1999, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
