The petitioner apprehends his arrest in Imadpur P.S. Case No.55 of 2021, registered for the offences punishable under Sections 341, 323, 504, 506, 498(A) and 34 of the Indian Penal Code.

The informant alleged that her husband has illicit relation with a woman. When she made protest, her husband ousted her from the house after assaulting her. Her husband always assaults her. When she gave information to her brother, her brother came to her matrimonial house and in front of Sonu Kumar (brother of the informant), her husband assaulted her. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

It is further submitted that the informant has earlier filed a complaint petition under Sections 498(A), 323 and 341 of the Indian Penal Code, which is pending before the learned court below and the petitioner is on bail in that case. Again after 18 years of marriage, the informant has filed the present case. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhojpur, Ara in connection with Imadpur P.S. Case No.55 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
