The petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 363 of 2018 registered under Sections 413 and 414 of the Indian Penal Code. The accusation is that on receiving secret information about gathering of miscreants at Dariyapur Darihara Road near Yogibaba Temple, the informant and other personnel reached there. On seeing the police personnel, miscreants started to flee away but on chased, three persons were apprehended with five motorcycles, who disclosed their names as Anu Kumar, Manjesh Giri and Suraj Kumar, but they did not give any satisfactory reply about the aforesaid five motorcycles and

Learned counsel for the petitioner submits that petitioner is not apprehended at the spot rather his name has come in the confessional statement of Anu Kumar, Manjesh Giri and Suraj Kumar, who were apprehended at the spot and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M.-IV, Saran at Chapra, in connection with Dariyapur P.S. Case No. 363 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
