The petitioner being the elder brother of the husband of the informant is languishing in custody since 18.09.2014 in a case registered for the offences punishable under Sections 307 and 498A/34 of the Indian Penal Code. The informant has alleged that the husband and entire in-laws family including the petitioner entered into her room, sprinkled kerosene oil and lit fire causing injury to the informant and her infant child.

It is submitted by learned counsel for the petitioner that during investigation it transpired that the in-laws extinguished the fire and the informant tried to commit suicide

Patna High Court Cr.Misc. No.9591 of 2015 (03) dt.30-04-2015 2/2 after some scuffle with her husband.

It is submitted by learned counsel for the State and the informant that there is specific accusation against the petitioner and the victim received 30% burnt injury. Though, the investigating agency has not collected the injury report of the child, but, in fact, the child has also received burnt injury. Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with Dulhin Bazar P.S. Case No. 146 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Danapur. Accordingly, the prayer for bail of the petitioner is rejected.
