JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 354B, 504/34 of the Indian Penal Code and 37(c) of Bihar Prohibition and Excise Act.

Petitioner is in jail custody since 17.02.2019 on the accusation that he made attempt to outrage the modesty of informant's wife in drunken stat.

Submission on behalf of the petitioner is that petitioner has been falsely implicated in this case and as a matter of fact, some altercation had taken place between the petitioner and the informant on petty issues, resulting filing of

Patna High Court CR. MISC. No.32873 of 2019(2) dt.20-05-2019 2/2 instant false case.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-II, Sheikhpura in connection with Barbigha ( Mission O.P) P.S. Case No. 43 of 2019.
