Since both the Criminal Misc. applications arise out of the same occurrence, they have been heard together and are

Patna High Court Cr.Misc. No.6674 of 2016 (3) dt.12-04-2016 being disposed of by this common order.

The petitioners seek bail in a case registered for the offences punishable under sections 386, 387/34 of the Indian Penal Code.

Allegedly the three petitioners armed with Pistol boarded in a Maruti Swift Vehicle, came at the wine shop where the informant was working as a Manager and demanded the ransom of Rs.50,000/- and took away Rs.4000/- from the counter and five bottles of wine and caused threats to pay money within two days otherwise to shoot him.

Submission is of false implication and that the petitioners were apprehended with the said vehicle but no fire arm or any weapon or wine was recovered, the amount alleged to be snatched away was also not recovered and as such, the petitioners, who are suffering in custody since 02.01.2016 deserve sympathetic consideration.

Learned A.P.P opposed the prayer by submitting that during investigation the witnesses have supported the allegation.

In the facts and circumstances stated above and considering that charge-sheet has already been submitted and that there is no chance of tampering with the prosecution evidence, the
