JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-04-2016 Learned counsel for the petitioners seeks permission to withdraw Anticipatory Bail Petition of petitioner no. 1 Indal Singh and petitioner no. 3 Sonu Singh @ Sonu Patel, who have got criminal antecedents.

Prayer is allowed.

The Anticipatory Bail Petition of above named petitioner no. 1 and 3 is dismissed as withdrawn.

If the petitioner no. 1 and 3 surrender in the court below, the learned court below shall consider the prayer for regular bail of both the petitioners on its own merits taking into consideration that

Heard both sides so far as the petitioner no. 2, 4, 5, 6, 7 & 8, namely, Vikash Singh @ Munna, Amit Singh, Meghu Singh, Santosh Singh, Manuu Singh @ Mannu Singh and Narendra Singh respectively are concerned, who are apprehending their arrest in a case under Sections 147, 149, 353, 427, 435, 323, 504, 295 of the Indian Penal Code.

It is submitted that one person was killed for which Bhabhua P.S. Case No. 52/2016 was registered. The petitioners and others are alleged to have surrounded the accused of Bhabhua P.S. Case No. 52/2016 and they wanted to settle the score themselves. It is submitted that no specific allegation is made against them. They have been implicated in Bhabhua P.S. Case No. 55/2016 and 56/2016 arising out of the same incident. Similarly situated accused persons have already been enlarged on anticipatory bail. Considering the facts aforesaid, the above named petitioner no. 2, 4, 5, 6, 7 & 8, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the
