The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a)/41 of the Bihar Prohibition & Excise Act. There is recovery of 300 litres of country made liquor from Hemja Bharat Forest area. The name of the petitioner came in light on the basis of statement given by local chowkidar.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious

It is further submitted that the petitioner has no any concern either with the seized liquor or with the place of seizure. The place of seizure is an abandoned place with the accessibility to any people. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge 1st, Nawada in connection with Sirdala P.S. Case No.223 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
