2. This application for anticipatory bail arises out of Bhagwan Bazar P.S. Case No. 428 of 2025 dated 23.07.2025, registered for the offence punishable under Sections 115(2), 126(2), 118(1), 109, 351(2)(3), 352, 303(2), 76 and 3(5) of B.N.S.
3. As per the allegation, on a trivial issue, there is initially a general and omnibus allegation against the petitioners and others to have assaulted the aunt and wife of the informant. It has further been alleged that petitioner No.2 (Arjun Kumar)
Patna High Court CR. MISC. No.35116 of 2026(2) dt.21-05-2026 2/3 with an intention to kill assaulted upon the informant by means of knife, thereby injuring his left eye. Thereafter, it is alleged that petitioner no.1 (Hariom Prasad) assaulted the wife of the informant by means of rod due to which she sustained head injury. It has further been alleged that Lilami Devi assaulted on the head of the informant by means of bricks. It has further been alleged that petitioner no.2 (Anand Kumar) snatched a gold chain from the neck of the informant and also tore the clothes of the wife of the informant. It has further been alleged that the aunt of the informant was assaulted by petitioner no.1 (Hariom Prasad) on her waist.
4. Learned counsel for the petitioners has submitted that the petitioner are innocent and have falsely been implicated in this case. It has further been submitted that the occurrence took place suddenly without any premeditation to kill. It has further been submitted, with reference to Annexure-P/2, that the injuries sustained by the informant, his wife and her aunt are simple in nature. It has further been submitted that both the parties are neighbours. It has lastly been submitted that petitioners have got no criminal antecedent.
5. Learned counsel for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

6. Heard the parties and perused the record.
7. Considering the facts and circumstances, let the petitioners above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 428 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
