====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-09-2019 Heard learned counsel for the petitioner. Although name of learned Advocate-on-Record for the Life Insurance Corporation of India appears in the cause list but no one appears on behalf of the Life Insurance Corporation of India.
Petitioner, in the present case, has prayed for a writ in the nature of mandamus commanding the
Patna High Court CWJC No.11385 of 2019(2) dt.03-09-2019 2/3 respondents to consider the claims of the petitioner arising out of the life insurance policy bearing No. 537684250 obtained by her husband (since deceased). It is submitted that the policy holder died on 27.11.2017 due to illness during his treatment in Patna Medical College & Hospital, Patna.
It is further submitted that the petitioner has filed her claim before the respondent authorities for settlement in prescribed form but nothing has been done so far. It is also submitted that the petitioner contacted the respondent authorities on several occasions to settle the claim of the policy but the matter is still pending before them.
In the given facts and circumstances of the case, since neither any counter affidavit is available on record nor anyone appears to represent the Life Insurance Corporation of India, this court directs the Divisional Manager, Life Insurance Corporation of India, Divisional Office, Muzaffarpur as also the Branch
Patna High Court CWJC No.11385 of 2019(2) dt.03-09-2019 3/3 Manager, Life Insurance Corporation of India, Vaishali to look into the grievance of the petitioner, if the claim under the said policy is still pending consideration, the same be decided within a period of three months from the date of receipt/production of a copy of this order. The decision taken by the competent authority on the claim of the petitioner be communicated to the petitioner immediately together with all supporting materials, if any.
In case, the petitioner is found entitled for the claim, the same shall also be made within the next one month from the date of taking such decision together with interest in terms of the provisions of the Protection of Interest of Policy and Regulation, 2002 as updated by Regulation 2017.
The Writ Application stands disposed off accordingly.
