Petitioners seek bail in a case registered under sections 302, 201, 34 of the Indian Penal Code. The prosecution case in brief is that informant viz. Gulden Paswan orally stated before the police that on 02.10.2014 his son Pintu deceased aged 14 years and nephew Chhotu Kumar deceased aged 12 years had gone to village fair and since that day disappeared. It is further stated that an application was also given to police station. It is further stated that the informant learnt through news paper that two unidentified corpses were lying in Bihra. It is stated that informant identified

It is alleged that on the same fateful day the deceased were taken to fair by a covillager namely Gaurav Kumar Paswan. It is alleged that all the accused persons killed the boys and disposed of the dead body. It has been submitted on behalf of the petitioners that petitioners are named in the first information report merely on suspicion. Except that there is no other allegation and evidence in the present case against the petitioners. It is further submitted that petitioners are in custody since 13.01.2015 and charge sheet has been submitted in the case.

On behalf of the State it has been submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in Bihra P.S. Case no. 164 of 2014. (Sudhir Singh, J) M.Rahman/- U T
