JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

It is submitted on behalf of the petitioner that the mother of the petitioner died on 26-04-2015 and presence of the petitioner is desirable in last rituals of his mother. It is further contended by him that the petitioner, being husband of the informant, is languishing in jail custody since 09-01-2015 in a case registered under Sections-498A, 307. 504, 323/34 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act and even if, prosecution story assumed to be true, then also, the petitioner has sufficiently been punished by remaining in jail custody since long.

No.13243 of 2015 (2) dt.01-05-2015 2/2 Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nawada Town P.S. Case No. 690 of 2014 to the satisfaction of Chief Judicial Magistrate, Nawada.
