JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Simri P.S. Case No. 10 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of huge quantity of liquor from one Bolero vehicle and people disclosed the name of the petitioner, who succeeded in fleeing away.

Submission of learned counsel for the petitioner is that the involvement in this case is false and concocted and identification itself is doubtful as no name of villager has been disclosed and he has no criminal antecedent.

Heard learned APP also.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to

Patna High Court CR. MISC. No.33569 of 2019(4) dt.25-09-2019 2/2 surrender in the court below within a period of two weeks from the receipt of this order and learned Special Judge shall verify the fact as to who are the persons who have disclosed the name of the petitioner from the case diary and if there is nothing like that, the petitioner shall be released on bail to its own satisfaction, otherwise petitioner has to surrender and pray for regular bail.
