JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411/34 of the Indian Penal Code.

Petitioner and two others were caught by the police while they were cutting electric wire and in huge quantity, electric wire was recovered from the place of occurrence. Petitioner does not have any criminal antecedent and submission on behalf of the petitioner is that petitioner was caught by the police on mere suspicion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.15087 of 2016 (2) dt.12-04-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Paharkatta P.S. Case No. 06 of 2016.
