The petitioner is in custody in a case registered under Sections 366A/34 of the Indian Penal Code.

The prosecution case in, brief, is that one Nejam Ansari, father of the victim stated before the police on 10.3.2015 that at about 8.30 A.M. her daughter came out side of house where named accused persons who are resident of same village abducted her for illegal works. It is further alleged that after search, informant filed Sanha on 11.3.2015 and on 13.3.2015 early morning the accused, namely, Dipak Sharma along with associate left her near Dehri railway station.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.21244 of 2015 (2) dt.14-07-2015 2/2 petitioner is in custody since 17.3.2015 and the charge sheet has been submitted in the present case. Further it is submitted that the petitioner has falsely been implicated in this case as to when he has not committed any offence, as alleged in the FIR. Further it has been submitted that the victim under motivation of her parents has falsely been implicated in the present case. It is also submitted that the petitioner may be released after completion of nine months of custody from 17.03.2015.

On behalf of the State it has been submitted that the petitioner is named in the FIR and there is specific allegation against him.

Considering the facts aforesaid, the above named petitioner shall be released on bail, after completion of nine months of custody from 17.03.2015, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sasaram, Rohtas in Sasaram (M) P.S.Case No. 293/2015.
