The petitioner seeks bail in Muffasil (Begusarai) P.S. Case No. 330 of 2010, registered for the offence punishable under Section 395 of the Indian Penal Code.
As per the prosecution case, while informant (Manager of liquor shop) along with other staff was at liquor shop, 06 miscreants having arms entered into the shop, out of them 02 miscreants came near the counter and on the point of pistol took cash of Rs. 20,000/- from the cash box. Other 02 miscreants took away his mobile and two cartoons of liquor and they all fled away.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of
Patna High Court CR. MISC. No.44938 of 2021(2) dt.03-11-2021 2/2 investigation, name of this petitioner has come in this case on the confession of co-accused Shrawan Kunwar. No stolen article has been recovered from possession of this petitioner. Petitioner is in custody since 13.08.2019.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Begusarai in connection with Muffasil (Begusarai) P.S.
