The petitioner has renewed his prayer for bail in connection with Sessions Case No. 605 of 2014 arising out of Bariyarpur P.S. Case No. 31 of 2014 registered under Sections 25(1-AA), 25(1-B)(a), 25(1-C), 26(1),(2)(3) and 35 of the Arms Act.
The prayer for bail of the petitioner and one Md. Jadruddin was earlier rejected by this Court vide a common order dated 10.10.2014 passed in Cr.Misc. No. 33175 of 2014 and Cr.Misc. No. 33888 of 2014.
It has been contended by the learned counsel for the petitioner that the co-accused Md. Jadruddin, whose case is
Patna High Court Cr.Misc. No.14284 of 2016 (2) dt.20-04-2016 2/2 identically situated to that of the petitioner, has already been granted bail by this Court subsequently vide order dated 02.03.2016 passed in Cr.Misc. No. 4786 of 2016. It is also contended that the last witness in this case was examined during trial on 22.08.2015 and since then no prosecution witness has turned up to depose before the court.
Learned counsel for the State has opposed the application for grant of bail to the petitioner. Regard being had to the facts and circumstances of the case, the petitioner Md. Aashim @ Md Aashim Alam @ Ashim Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, V, Munger in connection with Sessions Case No. 605 of 2014 arising out of Bariyarpur P.S.
