JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is languishing in custody since 28.03.2015 in connection with Majhaulia P.S. Case No. 128 of 2015 for the offences instituted under Sections 448, 341, 323, 354(A)(i)(ii)(iv) of the I.P.C. and 8 of the POSCO Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 26.03.2015 at about 9 O'clock in the night her daughter, namely, Sobha Kumari aged about 12 years and Sarita Kumari aged about 11 years were sleeping in their room and she was at her door, waiting for her husband, in the meanwhile, petitioner entered in the house of the informant and starting teasing to her elder daughter. No.22190 of 2015 (2) dt.16-07-2015 2/2 daughter awoken and identified the petitioner in the light and raised an alarm, then the informant and her son, namely, Saheb Mahto went in the room and all of them caught the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.03.2015 and the charge sheet has been submitted in the present case. It is further submitted that the matter has been settled between the parties vide annexure-3 to the present application. It is further submitted that the petitioner has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional District & Sessions Judge-cum-Special Judge, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No. 128 of 2015, corresponding to S.G.R. No. 31/2015.
