Petitioner is not named in the first information report but from perusal of the impugned order, I find that the name of petitioenr came in confessional statement of co-accused Abbas Mian and ,subsequently, some witnesses claimed to have seen the petitioner fleeing away from the place of occurrence. Co-accused Abbas Mian has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 27.03.2014 passed in Cr. Misc.No. 40327 of 2013. Moreover, petitioner is in jail custody since 03.01.2016 and he does not have any criminal

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Raxaul at Motihari in connection with Palanwa P.S.Case No.18 of 2013.
