JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public prosecutor for the State. Petitioner is said to be main assailant of the deceased and charge against him has been framed on 5.5.2012 but up till now his trial could not be completed.

The report of the trial court reveals that only three prosecution witnesses could be examined and to procure attendance of remaining prosecution witnesses, processes have already been issued including D.O letter to S.P, Munger but all went in vain.

Considering the facts and circumstances of the case as well as submissions of the parties the prayer for bail of the

Patna High Court Cr.Misc. No.21400 of 2015 (3) dt.24-06-2015 2/2 petitioner in connection with session trial no.297 of 2012 arising out of Muffasil P.S.Case No.193 of 2011 is again rejected. However, the learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt / production of copy of this order. Let copy of this order be sent to S.P, Munger with direction to him to insure the presence of remaining prosecution witnesses before the court of Additional District &Sessions Judge II, Munger, failing which the matter shall be viewed seriously.

The petitioner may renew his prayer for bail, if his trial is not concluded within the above stated period of six months. (Hemant Kumar Srivastava, J) Namita/- U T
