The petitioner is languishing in custody for the offences punishable under Section 412 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

Recovery of looted articles is from the possession of co-accused Vivek Kumar @ Kamru Paswan. On his disclosure statement name of this petitioner surfaced. The petitioner is in custody since 28.10.2018.

Submission is that the petitioner was never put on Test Identification Parade during investigation nor any incriminating article was recovered from the possession of the petitioner.

No.32005 of 2019(2) dt.14-05-2019 2/2 Considering the nature of material against the petitioner and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Shahjahanpur P.S. Case No.82 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
