JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 380/34 of the Indian Penal Code.
Petitioner was neither caught on the spot nor anything was recovered from conscious possession of the petitioner. The name of the petitioner was disclosed by co-accused, who was caught on the spot. So far as criminal antecedent of the petitioner is concerned, it has specifically been pleaded that petitioner had been made accused in only two cases but I.O. wrongly noted at paragraph-42 of the case diary that petitioner was earlier made accused in four cases.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named
Patna High Court Cr.Misc. No.14737 of 2016 (2) dt.08-04-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-1, Araria in connection with Jogbani P.S. Case No.01 of 2016.
