The petitioners are languishing in jail since 27.10.2015 in connection with Bachhwara, P.S. Case No.164 of 2015 for offences punishable under sections 364, 302 and 392 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that the driver and helper of the tank lorry bearing registration no.

BR09J-7129 were overpowered at the point of pistol by the miscreants and after killing the driver and the helper, the dead body were thrown and further, the tank lorry was kept at petrol pump at Muslidharawi, Dharbhanga. During investigation, the petitioner and others were apprehended when they were making plan to commit crime. The petitioner and others confessed their guilt.

No.16263 of 2016 (3) dt.26-05-2016 Learned counsel for the petitioner submits that except the aforesaid material, there is nothing against the petitioner and moreover, co-accused, Govind Kumar, Sonu Kumar and SantoshRai, having more or less similar allegation, have already been granted privilege of bail by different Benches of this Court. Considering the above facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of like amount to the satisfaction of learned Judicial Magistrate 1st class, Begusarai in connection with Bachhwara, P.S. Case No.164 of 2015.
