Petitioners apprehend arrest in a case registered for the offence punishable under Sections 366A/34 of the IPC. As per the prosecution case, informant alleges that when his wife and daughter were alone at home her daughter
Patna High Court CR. MISC. No.35243 of 2022(2) dt.01-11-2022 2/2 was kidnapped by FIR named accused persons including these petitioner with intention to marry her.
Learned counsel appearing for the petitioners submits that specific acquisition of kidnapping is against co-accused Krishna Kumar Mushar. The police after investigation, submitted final form and the girl in her section 164 Cr.P.C. statement has stated that she had gone to the house of her mausi without informing her parents she has not made any allegation against the petitioners.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned additional session Judge-7 cum-Special Judge POSCO, Bettiah in connection with Bagha Mahila P.S. case no. 39 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
