JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 11-03-2015 When the matter has been taken up for consideration on merit, a counter affidavit on behalf of the Bihar State Power Holding Company Ltd. is being filed, after service of its copy upon the learned counsel appearing on behalf of the petitioner, stating therein that the order dated 15.04.2013 passed in CWJC No.4766 of 2009 by this Bench has already been complied with. According to learned counsel appearing on behalf of the opposite parties in the light of the order of this Court the claim of the petitioner for compassionate appointment was considered, but by a reasoned and speaking order dated 10.06.2014 (Annexure-D to the aforesaid counter affidavit) the claim of the petitioner has been rejected.

In the aforesaid facts and circumstances, the present MJC application is disposed of as it has become infructuous.

Patna High Court MJC No.1259 of 2014 (2) dt.11-03-2015 However, if the petitioner is so aggrieved, a liberty is granted to him to challenge the validity and correctness of the aforesaid order dated 10.06.2014 (Annexure-D to the aforesaid counter affidavit) in an appropriate proceeding before the appropriate forum/court.
