The petitioners, namely, Raj Kishore Kumar @ Raj Kishore Singh and Rohit Kumar Singh @ Rohit Kumar seek bail in a case under Section 420 and other sections of the Indian Penal Code.

Patna High Court Cr.Misc. No.21543 of 2015 (3) dt.07-09-2015 2/2 The police got information that a gang of criminals indulged in withdrawing money from ATMs was moving in a white colour vehicle. On such information, the police intercepted the vehicle and arrested both the petitioners. From the possession of Raj Kishore Kumar @ Raj Kishore Singh, one SBI ATM card of Md. Firoz, one withdrawal slip and 10,000 rupees were recovered, but the withdrawal slip does not tally with the number of the ATM card of Md. Firoz. Similarly, one ATM-cum-VISA card of Ramayan Singh was recovered from the possession of Rohit Kumar Singh @ Rohit Kumar. It is submitted that the petitioners have got no criminal antecedents and they are in jail since 05.02.2015.

There is no allegation that the petitioners ever illegally withdrew money from ATM of any other person. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Sadar P.S. Case No. 56 of 2015.
