Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Excise P.S. Case No. 118 of 2021 registered under Sections 30 (a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2021, and is a person of clean antecedent and charge-sheet has been submitted. Allegation is of recovery of 1013 litres of liquor from a Pick Up
Patna High Court CR. MISC. No.44773 of 2021(2) dt.10-12-2021 2/2 Van as detailed in the F.I.R. during vehicle checking. Learned counsel further submits that the petitioner is not the owner of the vehicle rather he is the driver of the vehicle and as such he was unaware what was transported in the vehicle. Learned APP for the State opposes the prayer of regular bail application of the petitioner.
Considering the fact that the petitioner is in custody since 19.03.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-Iind cum Special Judge, (Excise), Gaya in connection with Excise P.S.
