JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,307 and 504 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the informant was in his hut when the accused persons came, made assault with iron rod and Farsa to the informant, informant's father, mother, sister and others. It is submitted by learned counsel for the petitioners that in the background of bonafide land dispute which is claimed
Patna High Court Cr.Misc. No.21597 of 2015 (2) dt.20-05-2015 2/2 by the petitioner being purchased land the accusation has been levelled. There is counter version of the occurrence also. It is submitted by learned Special P.P. that some of the injuries have been found to be grievous and the complaint lodged by the petitioners' side is subsequent to the case of the informant. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Tajpur P.S. Case No. 45 of 2015 pending in the court of learned C.J.M., Samastipur. This application is disposed of with the aforesaid observation/direction.
