The petitioner seeks bail in Kasimbazar P.S. Case No. 244/2017, instituted for offence under Section(s) 366(A) of the Indian Penal Code.
Learned counsel for the petitioner has submitted that informant has raised suspicion against this petitioner for kidnapping his sister.
The victim has given statement under Section 164 Cr.P.C., wherein she has levelled allegation against this petitioner that he had taken her to Kolkatta and established physical relation with her.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.32549 of 2019(3) dt.17-07-2019 2/2 compromise petition has been filed in the court of learned Chief Judicial Magistrate, Munger, wherein victim has not supported the allegation levelled against this petitioner. Copy of compromise petition is annexed as Annexure-3. Petitioner is in custody since 30.01.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Munger, in connection with Kasimbazar P.S. Case No. 244/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
