The petitioners seek bail in a case registered under sections 20 and 22 of the N.D.P.S. Act. On secret information that the accused persons were selling ganja, the police officer raided and caught the petitioners and on recovery 7.500 kg ganja was recovered from a gunny bag of Binod Choudhary. The police also raided the house of the petitioner Hare ram and recovered 4 packet of ganja weighing 7.500kg and from the house of Arun Sah the police officer recovered 6kg of ganja.

It has been submitted on behalf of the petitioners

Patna High Court Cr.Misc. No.21359 of 2015 (2) dt.16-07-2015 2/2 that from the possession of petitioner no.1 7.500kg ganja is alleged to have been recovered and from the possession of petitioner no.2, 6 kg ganja is said to have been recovered. It is further submitted that the said amount of much below than the commercial amount. It is further submitted that the petitioner have no criminal antecedent and they are in custody since 27.03.2015. It has further been submitted that the charge sheet has already been submitted in the case.

On behalf of the Stated it is submitted that the petitioners are named in the first information report. Considering the aforesaid facts, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Darbhanga in G.O. Case NO. 10 of 2015 arising out of Kusheshwar Asthan P.S. Case No. 107 of 2015. (Sudhir Singh, J) M.Rahman/- U T
