Petitioner seeks bail in a case registered initially, under Sections-307, 379 & other minor sections of the Indian Penal Code, in which, later on, Section-302 of the Indian Penal Code was also added.

Although petitioner is named in the first information report with allegation that he along with several others went at the house of informant but it is specific that other co-accused assaulted the informant as well as the deceased of the present case and so far as petitioner is concerned; no specific overt act has been attributed against him. Moreover, having more or less similar allegation, one co-accused namely, Rasid Mian has already been

Patna High Court Cr.Misc. No.15258 of 2016 (2) dt.18-04-2016 2/2 granted privilege of bail by this court.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sathi P.S. Case No. 179 of 2015 corresponding to Sessions Trial No. 04 of 2016 to the satisfaction of Learned Additional Sessions Judge-III, Bettiah, West Champaran. (Hemant Kumar Srivastava, J) A.K.V./- U T
