JUSTICE HEMANT KUMAR SRIVASTAVA) 13-01-2020 Today, this Letters Patent Appeal has been listed under heading for order on petition and accordingly, I.A. No.8254 of 2018 has been pressed for passing order. The aforesaid Interlocutory Application No.8254 of 2018 has been filed on behalf of the appellants for condonation of delay of one day in filing this appeal.

It is informed that bunch of writ applications were decided by a common judgment dated 18.05.2018 and the aforesaid order dated 18.05.2018 passed by the writ Court was challenged before the Division Bench of this Court by filing Letters Patent Appeal No.780 of 2018, which stood dismissed

Patna High Court L.P.A No.1341 of 2018(3) dt.13-01-2020 2/2 and that order of the Division Bench was challenged before the Hon'ble Apex Court and the Apex Court also confirmed the judgment of the Division Bench passed in L.P.A. No.780 of 2018 vide order dated 05.10.2018 passed in Special Leave to Appeal (C) No.24799 of 2018 and the similar issue is involved in this Letters Patent Appeal. Therefore, in view of the aforesaid, the issue involved has already been decided upto the Apex Court.

Accordingly, this appeal stands dismissed and the I.A. No.8254 of 2018 also stands disposed of in light of this order. (Hemant Kumar Srivastava, J) ( Prabhat Kumar Singh, J) Vikash/- U
