JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that the name of petitioner came in this case in course of investigation at para-19 of the case diary.

Learned counsel for the petitioner submitted that in course of investigation, the spy of police disclosed the name of petitioner and, after that, confessional statements of petitioner and other co-accused were recorded and except that, there is nothing against the petitioner. It is further submitted that investigation has already been completed and petitioner does not have any criminal antecedent. It is also pointed out that co- accused Niles Thakur @

Patna High Court Cr.Misc. No.14513 of 2016 (2) dt.08-04-2016 2/2 Nilesh Kumar, who is named in the first information report, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- XI, Bhagalpur in connection with Pirpainty P.S.Case No. 309 of 2015.
