====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-04-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code, registered in connection with Shikarpur P.S.Case No. 406 of 2020.

As per allegation, the petitioners came to the house of the informant and on the order of petitioner no.1, petitioner no.2 assaulted the informant with a farsa on his head. The allegation against petitioner no.2 is that he assaulted Sadre

Patna High Court CR. MISC. No.45380 of 2021(2) dt.13-04-2022 2/2 Alam, the son of the informant and made him injured and Dhanesh Ram assaulted Dilsad Alam.

The learned counsel for the petitioners has submitted that there is case and counter case and both the parties have sustained injuries. The injured Sadre Alam has sustained grievous injury, which is attributed against petitioner no.2. As such, the anticipatory bail petition against petitioner no.2 Naresh Ram is rejected.

So far as petitioner nos. 1, 3 and 4 are concerned, let them in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Shikarpur P.S.Case No. 406 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
