The petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 353 of the Indian Penal Code.

The informant, a police constable alleged that while going on his duty four persons intercepted him and snatched his service revolver. Three persons fled away on the motorcycle. On chase one of the accused namely Sudhir Kumar Mehta was apprehended who disclosed the name of Anubhav Singh @ Anu, but did not disclose name of two other accused persons. Shri Ajit Kumar Singh, learned counsel for the petitioner submits that there is no allegation of snatching against the petitioner. Allegation of snatching of service revolver is

Patna High Court Cr.Misc. No.21704 of 2015 (3) dt.08-09-2015 2/2 against Anubhav Singh @ Anu. The petitioner is in jail since 28.02.2015, but it appears that the petitioner along with Anubhav Singh @ Anu and two other accused persons intercepted the police constable and robbed his service revolver. Anubhav Singh @ Anu fled away with the service revolver along with two unknown accused persons on a motorcycle, but the petitioner was apprehended on chase.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail at this stage. Accordingly, the same is rejected.
