JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-02-2021 Heard Mr. Virendra Kumar, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with L.N.M.U. (University) P.S. Case No. 104 of 2018, dated 17.05.2018, instituted for the offences under Sections 379 and 420/34 of the Indian Penal Code. One person is said to have been nabbed while trying to snatch away the A.T.M. card of the informant. The petitioner has been named by the arrested accused person as one of his associates.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.32478 of 2020(2) dt.12-02-2021 2/2 that there is no recovery of any incriminating material from him.

Considering the aforesaid aspect of the matter, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Darbhanga, in connection with L.N.M.U. (University) P.S. Case No. 104 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

While saying so, this Court has also taken note of the fact that the petitioner does not have criminal antecedents.
