====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 02-06-2026 Heard the learned Advocate for the petitioner and the learned Advocate for the Vigilance Investigation Bureau, Patna through virtual mode.

2. The petitioner apprehends her arrest in connection with Bokhra P.S. Case No. 10 of 2026, registered for the offences punishable under Sections 420, 467, 468 and 120(B) of the Indian Penal Code.

3. Based upon the written report, the prosecution alleges that in deference to the order of the Patna High Court passed in C.W.J.C. No. 15459 of 2014, verification of educational certificates of teachers appointed between 2006 to 2015 was directed. During verification conducted by the Vigilance Investigation Bureau, Patna, the Madhyama marksheet submitted by the petitioner at the time of her appointment

Patna High Court CR. MISC. No.35674 of 2026(2) dt.02-06-2026 2/3 as Block Teacher in the year 2006 was found to be forged and fake and consequently, the present FIR came to be instituted.

Learned Advocate for the petitioner submitted that in fact the petitioner herself is the victim of the circumstances and despite the fact she appeared in the Madhyama examination, it appears that an incorrect certificate has been issued, which requires proper investigation. It is submitted that the petitioner was appointed after due verification by the appointing authority and she has been serving as a Block Teacher for the last 15-20 years, without there being any complaint. Before institution of the FIR, the petitioner has never been put to notice or given any opportunity to place the materials to rebut the allegation. However, the petitioner is ready to abide by the direction issued by the Education Department. The petitioner is a woman, having fair antecedent and undertakes that she will fully co-operate in the investigation or in the proceeding of the Court. It is lastly submitted that in identical matters, this Court has extended the privilege of anticipatory bail to other candidates, whose certificates have been found forged and fabricated, in course of verification.

5. On the other hand, learned Advocate for the Vigilance Investigation Bureau opposed the pre-arrest bail application and submitted that from the materials available on record, it does not appear that the services of the petitioner has

Having considered the submissions advanced on behalf of the learned Advocate for the respective parties and taking note of the fact that the allegation requires intensive investigation, moreover, the petitioner is a woman, having fair antecedent and she undertakes that she will fully co-operate in the investigation or in the proceeding of the Court, let the petitioner above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Bokhra P.S. Case No. 10 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
